成都愛旗科(kē)技(jì )有(yǒu)限公(gōng)司（“愛旗”）的一項基本政策是嚴格遵守和執行中(zhōng)國(guó)及包括美國(guó)在内的國(guó)際相關的出口管制法律法規，切實履行出口管制責任和義務(wù)，樹立企業誠信經營和負責任的國(guó)際形象，以赢得合作(zuò)夥伴和客戶的信賴。愛旗同時認為(wèi)，自覺遵守适用(yòng)的出口管制法律法規，能(néng)夠使公(gōng)司有(yǒu)效防範貿易合規風險，不斷提升公(gōng)司在國(guó)際市場的持續競争力，為(wèi)公(gōng)司的長(cháng)期發展提供有(yǒu)效保障。
A basic policy of Chengdu Aich Technology Co.,Ltd(“Aich”) is to strictly abide by and implement China’s and the relevant international export control laws and regulations including the United States, earnestly fulfill the export control responsibilities and obligations, and establish an international image of corporate integrity and responsibility, so as to win the trust of partners and customers. Aich also believes that consciously complying with applicable export control laws and regulations can enable the company to effectively prevent trade compliance risks, continuously improve the company's sustainable competitiveness in the international market and provide effective guarantee for the company's long-term development.
愛旗以全面控制原則指導公(gōng)司内部出口管制體(tǐ)系的建立和實施，将公(gōng)司的出口管制義務(wù)置于公(gōng)司的商(shāng)業利益之上。
Aich guides the establishment and implementation of the company's Internal Compliance Program(“ICP”) with the principle of comprehensive control, placing the company's export control obligations above the company's commercial interests.
如果愛旗認為(wèi)将出口的有(yǒu)形或無形的産(chǎn)品、技(jì )術和服務(wù)可(kě)能(néng)被客戶或最終客戶用(yòng)于發展或制造大規模殺傷性武器及其運載工(gōng)具(jù)、未經授權的常規軍事裝(zhuāng)備或其他(tā)适用(yòng)法律法規所限制的最終用(yòng)途，可(kě)能(néng)會威脅國(guó)家和地區(qū)的和平與穩定，或是落入恐怖組織手中(zhōng)，愛旗将依據全面控制原則，自願實施嚴格的出口管制措施，并拒絕出口相關産(chǎn)品、技(jì )術和服務(wù)。本着“視同出口”管制的原則，愛旗還會認真進行内部監控和規範，以防員工(gōng)接觸到某些個人或組織可(kě)能(néng)會惡意使用(yòng)的敏感技(jì )術或信息。
If Aich believes that the tangible or intangible products, technologies and services to be exported may be used by customers or end customers to develop or manufacture weapons of mass destruction and their delivery vehicles, unauthorized conventional military equipment or other end uses restricted by applicable laws and regulations, which may threaten national and regional peace and stability, or fall into the hands of terrorist organizations, Aich will, in accordance with the principle of comprehensive control, voluntarily implement strict export control measures and refuse to export related products, technologies and services. Based on the principle of "Deemed Export" control, Aich will also carefully carry out internal monitoring and standardization to prevent employees from contacting sensitive technologies or information that may be maliciously used by certain individuals or organizations.
愛旗還對任何可(kě)能(néng)在業務(wù)運作(zuò)過程中(zhōng)要使用(yòng)的中(zhōng)介（如報關行、貨運代理(lǐ)人或托運人）進行核實，以免産(chǎn)生潛在的擴散轉移風險。愛旗拒絕與違法的公(gōng)司或個人進行業務(wù)往來。愛旗也意識到在按照政府要求确認敏感客戶、按照國(guó)際/國(guó)家标準區(qū)别産(chǎn)品編碼、産(chǎn)品最終用(yòng)途的實際舉措上，需要進一步與政府貿易合規主管機構、相關非政府組織和出口管制專家建立和保持密切聯系，以獲取相關技(jì )術信息、尋求專業指導和權威建議。
Aich also verifies any intermediaries (such as customs brokers, freight forwarders or shippers) that may be used in the process of business operations to avoid potential proliferation and transfer risks. Aich refuses to do business with illegal companies or individuals. Aich is also aware of the need to further establish and maintain close contact with government trade compliance authorities, relevant non-governmental organizations and export control experts to obtain relevant technical information, seek professional guidance and authoritative suggestions on practical measures to identify sensitive customers according to government requirements and distinguish product codes and product end uses according to international/national standards.
為(wèi)确保自身貿易合規體(tǐ)系的有(yǒu)效實施，愛旗設立出口合規委員會，全面負責審定公(gōng)司貿易合規體(tǐ)系的政策、制度、組織和流程，對貿易合規重大事項和解決方案進行審批和決策；同時由法務(wù)與風控部作(zuò)為(wèi)負責貿易合規管理(lǐ)工(gōng)作(zuò)的具(jù)體(tǐ)執行部門。此外，愛旗還在與出口合規業務(wù)相關的部門内設立一名(míng)貿易合規管理(lǐ)人員，負責組織協調部門内部的貿易合規管理(lǐ)工(gōng)作(zuò)，并負責同法務(wù)與風控部進行貿易合規管理(lǐ)工(gōng)作(zuò)對接。

為(wèi)确保落實貿易合規要求，愛旗明确各業務(wù)領域的職責，制定并發布相關指導文(wén)件，健全文(wén)檔保存機制，加強員工(gōng)及管理(lǐ)者的出口管制知識與技(jì )能(néng)的培訓，并定期進行貿易合規遵從體(tǐ)系的内部評估與審計。
In order to ensure the implementation of trade compliance requirements, Aich clarifies the responsibilities of each business area, formulates and issues relevant guidance documents, improves the document retention mechanism, strengthens the training of employees and managers on export control knowledge and skills, and regularly conducts internal evaluation and audit of trade compliance system.
愛旗要求全體(tǐ)員工(gōng)為(wèi)公(gōng)司實現貿易合規的目标做出努力，嚴格執行公(gōng)司相關政策。愛旗為(wèi)此設立獎懲制度，對積極參與出口管制工(gōng)作(zuò)的員工(gōng)給予獎勵，對違反公(gōng)司出口管制政策的員工(gōng)予以通報處罰。不遵守适用(yòng)法律法規的員工(gōng)，将依法承擔法律責任。
Aich requires all employees to make efforts to achieve the goal of trade compliance and strictly implement the relevant policies of the company. For this purpose, Aich has established a reward and punishment system to reward employees who actively participate in export control, and punish employees who violate the company's export control policies. Employees who do not comply with applicable laws and regulations will bear legal responsibilities in accordance with the law.
